Welcome to xam.icu ("we," "us," or "our"). We provide a privacy-focused AI answer engine website (the "Website") and Discord bot (the "Bot"), collectively referred to as the "Service." By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Description of Service
xam.icu provides users with AI-generated answers and search results in response to user queries through both our website and Discord bot. Our service is designed with privacy as a core principle. Access to certain features may require creating an account on the website or using the bot within Discord servers.
2. User Accounts Website
- Registration: To access certain features on the website, you must create an account by providing a username and email address. You agree to provide accurate and complete information.
- Account Information: Please note that due to the technical configuration of our authentication system (Firebase), your username and email address are permanent and cannot be changed after registration. If you have made an error or wish to use a different email or username, you must contact support at support@xam.icu to request a deletion of your current account, and then create a new one.
- Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You must notify us immediately at support@xam.icu upon becoming aware of any breach of security or unauthorized use of your account.
- Termination: You may request to delete your account at any time by contacting us at support@xam.icu, as outlined in our Privacy Policy.
3. Acceptable Use Policy
3.1 General Rules (All Services)
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law.
- Generate, transmit, or display content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful.
- Attempt to harm, disrupt, reverse-engineer, or "jailbreak" the AI models or our service infrastructure.
- Engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service).
- Attempt to gain unauthorized access to any part of the Service, or its related systems or networks.
- Use any automated system, such as "bots" or "scrapers," to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period, without our express permission.
- Attempt to get the AI to generate slurs, hate speech, or any other harmful or discriminatory content.
3.2 Discord Bot Rules Bot
When using the XAM Discord Bot, you additionally agree not to:
- Spam: Send excessive, repetitive, or unnecessary messages or commands to the bot. This includes flooding the bot with requests or using automated tools to interact with it.
- Abuse: Exploit bugs, glitches, or vulnerabilities in the bot for any purpose. Report any issues to support@xam.icu instead.
- Manipulation: Attempt to manipulate, trick, or "jailbreak" the bot into producing inappropriate, harmful, or offensive content, including slurs, hate speech, or discriminatory language.
- Impersonation: Use the bot to impersonate other users, bots, or entities.
- Server Disruption: Use the bot in ways that disrupt the normal operation of Discord servers or violate Discord's Terms of Service.
Violations of these rules may result in being blocked from using the bot, and in severe cases, being reported to Discord.
4. Discord Bot Data Bot
When you use the XAM Discord Bot:
- Data Collection: We store your Discord User ID and messages sent to the bot to provide conversation context. We keep up to 30 messages per server.
- Data Access: Use the
/mydata command to view all data we have stored about you.
- Data Deletion: Use the
/deletedata command to delete all your data from our systems at any time.
- Daily Message Limit: Each user has a limit of 30 messages per day. The limit resets at midnight UTC.
- Privacy: Your data is stored securely in our database and is used only to provide conversation context for the AI. We do not share or sell your data.
5. AI-Generated Content
The AI-generated content provided by the Service is for informational purposes only. The content is generated by complex algorithms and may contain inaccuracies, errors, or omissions.
- No Professional Advice: The information provided is not a substitute for professional advice (e.g., medical, legal, financial, or technical). You should always verify information with a qualified professional before making decisions.
- No Warranty: We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of the AI-generated content. You use it at your own risk.
6. Disclaimers and Limitation of Liability
The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied.
To the fullest extent permitted by law, xam.icu, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- (a) Your use of or inability to use the Service;
- (b) Any content obtained from the Service, especially your reliance on it;
- (c) Unauthorized access to or use of our servers and/or any personal information stored therein.
7. Intellectual Property
The name "xam.icu," our logos, and the overall look and feel of the Service are our property. You may not use them without our prior written permission.
8. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including for violations of these Terms, without prior notice or liability. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, disclaimers and limitations of liability.
9. Changes to These Terms
We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
